TERMS & CONDITIONS OF SALE

These terms and conditions govern the sale of products to you by 12tribe records limited (hereafter "us") trading as a Merchant on the BigCommerce platform at http://shop.12triberecords.com. In addition to these terms and conditions, your use of the 12tribe records website is subject to 12tribe records' Terms Of Use.

Please read these conditions carefully before purchasing products from us. By ordering our products, you signify your agreement to be bound by these terms and conditions.

1. Our contract

When you place an order to purchase a product from us, you will be sent an e-mail confirming receipt of your order and setting out the details of your order. Your order represents an offer to purchase a product from us acting in our capacity as a Seller on the BigCommerce platform at http://shop.12triberecords.com, which is accepted by us when we send an e-mail confirmation stating that we've dispatched that product to you (the "Dispatch Confirmation E-mail"). This is the email that states your Order Status Changed to Shipped. That acceptance will be complete at the time we send this Dispatch Confirmation E-mail. Any products on the same order which have not been confirmed in a Dispatch Confirmation E-mail as having been dispatched do not form part of that contract.

2. Delivery

Items sold by us via our BigCommerce shop http://shop.12triberecords.com are dispatched from Northern Ireland. All items destined for U.K. addresses will be offered the opportunity for either 1st class standard or 1st class recorded delivery, with free U.K. delivery on all orders of £25 or more. It's not always possible to choose exactly which carrier we use for your order within the U.K. but, as with international orders, an appropriate carrier will be used to ensure to the best of our ability that satisfactory delivery times are achieved.  International Orders are offered the choice of either standard airmail or international signed-for delivery.

When you place an order, we estimate dispatch within 1-2 working days. Please contact customerservices@12triberecords.com if you have any further enquiry about delivery issues.

3. Delivery Rates

A shipping price estimate is calculated at the store checkout for you as a customer as defined by your delivery address specified (Country, State & Postcode) and then again by your preference as to how you would like your order delivered. So charges applied in relation to postage and packaging for products will be defined by you and indicated clearly at the time of order purchase. This charge, if estimated correctly, will in most cases be the charge applied for delivery of your product however we reserve the right to amend these shipping charges if for any reason this estimate calculated proves erroneous. If this is the case you will be informed prior to dispatch of your product(s) regarding any possible amended charge in relation to postage and packaging if applicable.

4. Cancel Items from an Order

You can cancel or amend any order placed via http://shop.12triberecords.com, provided that the order has not yet entered the dispatch process.

You should email customerservices@12triberecords.com with the words "Cancel item/order" in the subject line, quoting your name and order number. If the order you want to cancel is not yet dispatched, you can cancel it straight away. If it's dispatched, you will need to wait until the order is delivered to you before you can cancel the order by returning the goods in the proper condition and within the timeframe stated.

You will also be required to state a reason for cancelling the item.

Cancelling Orders from Third-Party Sellers

We cannot assist you in cancelling any orders you have placed for 12tribe records' products from other sellers (unless the order was fulfilled by 12tribe records via our BigCommerce store http://shop.12triberecords.com ). Instead, please contact the seller directly.

Credit or Debit Card Declined

If you receive notification that your credit or debit card has been declined, you must contact the bank that issued the card to find out why.

Note: only your bank can tell you why your card has been declined.

5. Returns Policy

Return Music: 7-day Returns Guarantee

-         If for any reason you are unhappy with a hardcopy music purchase from http://shop.12triberecords.com, you can return it to us in its original condition within 7 working days beginning with the day after you received it, unopened (with any seals and shrink wrap intact) and we will issue a full refund for the price you paid for it within 30 days of your cancellation notice. We reserve the right to refuse returns or to charge you our fees and expenses if the product is received otherwise than in accordance with these requirements.

Please note: We can only accept the return of opened items if they are faulty. This returns policy does not affect your statutory rights.

-         If for any reason you are unhappy with a download music purchase from http://shop.12triberecords.com, please email customerservices@12triberecords.com within 7 working days beginning the day after you download the product, advising us of your name, order details and the issue and we’ll replace or refund within 30 days of your cancellation notice. We reserve the right to refuse returns or to charge you our fees and expenses if the product is received otherwise than in accordance with these requirements.

- Specific information applies to the return of damaged, defective and incorrect items (see below).

Note: 12tribe records cannot accept returns of music items purchased from third-party sellers. Instead, contact your seller to let them know you would like to return the item to them.

Return a Damaged, Defective or Incorrect Item

This section explains what to do if you've received a damaged, defective or incorrect item from 12tribe records via http://shop.12triberecords.com. This returns policy does not affect your statutory rights.

If the item was damaged in transit

- If you take delivery of a http://shop.12triberecords.com package and the contents have been damaged in transit, you can return the item(s) to us within 7 working days, beginning the day after receipt, for exchange.

If the item is defective

- You have the right to return a faulty item within a reasonable period of time (generally within 7 working days, beginning the day after receipt). Please keep all your receipt information that accompanies your item as this may be needed should there be a fault.

- In case the item has become defective after 7 working days please contact our customer service by email customerservices@12triberecords.com to obtain returns information or in writing to: Customer Services, 12tribe records ltd., Ballymena Business Centre, Galgorm Industrial Estate, 62 Fenaghy Road, Galgorm, Ballymena, Co. Antrim, Northern Ireland. BT42 1FL.

If we sent you an item you did not order (an "incorrect" item)

- As soon as you find out we've sent you an incorrect item, send the incorrect item back to us with your receipt and we'll make sure you are not charged for it. If you want us to replace the item we sent you with the item you ordered, please notify us in writing or by email at the time of return, and we'll send you the correct item as soon as we can.

Please Note:  in the event of http://shop.12triberecords.com sending you a replacement for a damaged, defective or incorrect item, you must return the original item to http://shop.12triberecords.com within 21 working days of our e-mail confirming the issue of the replacement item. Provided you return this item to us within the 21 days, you will have nothing more to pay. If you do not return the original item to us by the end of the 21 day period, we reserve the right to charge an amount equal to the price of your original order to the payment card you used for the order. Until the goods are returned you will have an obligation to retain possession and take reasonable care of the goods until we receive delivery of them from you.

6. Pricing and availability

We list availability information for products sold by us on the http://shop.12triberecords.com platform. We cannot be more specific about availability. Please note that dispatch and delivery estimates are just that. They are not guaranteed dispatch or delivery times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable. All CD prices shown include VAT where applicable. If any products are to have extra charges applied in relation to postage and packaging this will be indicated clearly at the time of order.

7. Ownership and title

All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product leaves our premises in Northern Ireland.

8. Customs

If your delivery address is outside United Kingdom, the addressee will be the importer of record and must comply with all laws and regulations of the country into which the products are delivered. The product may be subject to import duties and taxes, which are levied once the package reaches the country of delivery. Any such additional charges levied for customs clearance must be borne by you. Please note that we have no control over these charges and cannot predict what they may be at any time in the future.

9. Privacy

12tribe records including 12triberecords.com and our shop platform http://shop.12triberecords.com are committed to protecting your privacy. We will only use the information collected from you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service. The type of information we collect about you is listed within our Privacy Policy and Terms & Conditions Of Use. The personal information which we hold will be held securely in accordance with the law.

10. Children

12tribe records via our BigCommerce shop platform http://shop.12triberecords.com does not sell products for purchase by children. We sell products for purchase by adults. If you are under 18 you may purchase products from us, through the 12tribe records' marketplace platform, but only with the involvement of a parent or guardian.

11. Electronic Communications

When you transact with us or send e-mails to us, you are communicating with us electronically. We communicate with you directly by e-mail or by posting notices via your http://shop.12triberecords.com store account area. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

12. Losses

12tribe records via http://shop.12triberecords.com will only be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you submitted your order to us, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us when you submitted your order to us or when a contract for the sale of goods by us to you was formed.

13. Alteration of service or amendments to the conditions

We reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

14. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your statutory rights.

15. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

16. Governing law and jurisdiction

Your relationship with us is governed by and construed in accordance with the laws of Northern Ireland. You agree, as we do, to submit to the non-exclusive jurisdiction of the Courts of Northern Ireland.
